CITY OF NORWICH NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that at a meeting of the Council of the City of Norwich held October 6, 2008, the following ordinance was introduced and set for public hearing on Monday, October 20, 2008, 7:00 PM: AN ORDINANCE AMENDING SECTION 3.14, Section 1.47 AND SECTION 15.1.3 OF THE NORWICH ZONING ORDINANCE WITH RESPECT TO HOME OCCUPATIONS, PROFESSIONAL OFFICES AND WORKSPACES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORWICH, that Sections 3.14, 1.47 and 15.1.3 of the Norwich Zoning Ordinances be and hereby are amended as follows: Sec. 3.14. Home Occupations and professional offices and workspaces. Any proposed home occupation, including Professional offices and workspaces, which the Zoning Enforcement Officer has determined to be compatible with a residential area shall be permitted. The dwelling cannot be substantially altered to make it impractical to use the structure as a dwelling. Where the proposed home occupation, including Professional offices and workspaces, will not materially change the traffic characteristics of the neighborhood and there is no other noticeable effect or storage of hazardous materials, the use is authorized by the issuance of a permit from the Zoning Enforcement Officer. Such permit shall not be transferable to any new owner or tenant of the property. Professional offices may include the office of a physician, surgeon and dentist, provided no patient is hospitalized or housed overnight; or the office of any recognized professional person residing on the premises. Professional workspaces may include studio space for music lessons, production of works of art, photography, film, video and audio recording. The conducting of a clinic, hospital, kennel, antique shop, barber shop, beauty parlor, tea room or similar use shall not be deemed to be a home occupation, professional office or workspace. Home occupations, including professional offices and workspaces, may be permitted in a conforming dwelling subject to the provisions of section 3.13 hereof; and further provided that: 3.14.1 The use is clearly incidental and subordinate to the use of the dwelling for residence purposes; 3.14.2 The use does not occupy more than 20 25 percent of the gross floor area of the dwelling nor change the residential character of the dwelling in any visible manner; 3.14.3 The use does not create objectionable noise, dust, odor, vibrations or unsightly conditions noticeable off the lot; 3.14.4 The use does not create interference with wireless networks, communications or radio and television reception in the vicinity; 3.14.5 The use does not create any health or safety hazard; 3.14.6 The use or occupation does not engage or employ more than two persons not residing in the dwelling. 3.14.7 For a home occupation, including professional offices and workspaces, parking shall be provided in accordance with Section 15.1.3, excepting that on street parking may be provided if such on-street parking does not create safety or traffic concerns or hazard as determined by the director of public works, the police chief and the commission on the city plan. It is the intent of this regulation to maintain yards and landscaping and the integrity of the neighborhood while providing for parking that meets the needs of the home occupation, including professional offices and workspaces; therefore, the commission on the city plan may waive the parking design standards listed in section 15.12 if it is determined by the commission that the parking is consistent with the intent of the regulations and will meet the needs of the proposed home occupation, professional office or workspace. The provisions of section 15.2 entitled Off-street loading shall not apply to a home occupation, professional office or workspace. 3.14.8 Signage pertaining to the home occupation, professional office or workspace must conform to regulations listed in Sec 16.8.2 Definitions Sec. 1.47 Professional office / workspace is the office and interrelated area used by of a member of a recognized profession including doctors or physicians, dentists, optometrists, ministers, architects, surveyors, engineers, consultants, public accountants, lawyers, artists, computer and word processing experts, graphic designers, authors, musicians and other recognized professional occupations. The issuance of a state or local license for regulation of any gainful occupation need not be deemed indicative of professional standing. Parking Sec. 15.1.3 For permitted home occupations and professional offices and workspaces in a residence, two parking spaces plus one parking space for each 200 square feet of building floor area devoted to such use.
